Buyer Terms

These terms should be read together with Terms Of Use for Production Asset Listing’s Website.

1. pal’s Marketplace is provided solely and exclusively as an online venue for buyers and sellers of production equipment which is being sold on a ‘sold as seen’ basis only. pal is not and will not be taken to be a party to any transaction or other relationship between a buyer and seller. The buyer hereby acknowledges and agrees that:

1.1 Buyers are not making purchases from pal and are not under any circumstances entering into a legal contract with pal. A buyer’s purchase is and will be taken to be exclusively with the seller and any contract that they have and enter into will be only be with the seller and not pal; 

1.2 pal will not be a party to any dispute between the seller and any buyer or any third party. Any claims made by the buyer must be made only against the seller and the buyer agrees to release pal from and indemnify pal against any and all claims, demands and damages of every kind and nature, known or unknown, arising out of or in any way their purchase of goods from the seller;

1.3 pal undertakes limited screening of a seller and offers no warranty or guarantee in relation to the goods offered for sale by the seller on the Site. Without limitation, pal is not in any way responsible for the condition, quality, safety or suitability of any goods sold or for the content of any listings; and

1.4 While the seller is required to comply with their own terms [insert hyperlink], which include provisions covering important matters such as payment methods, processing times, and delivery methods, pal recognises that payment methods, processing of transactions and delivery methods (or prices) may vary. It is the seller’s responsibility and not pal to make all the terms of sale clear in their posting and pal offers no guarantee or warranty or any assurance whatsoever that what is being offered is as is described and accepts no responsibility for representations made, omissions or the wrong or inaccurate listing of an item for sale.

2. Goods sold via the Site can take any form, they must however be free from intellectual property rights. By advertising an asset for sale via a posting on the Site the seller legally assures any prospective buyer that any transfer by sale shall be rights-and royalty-free and shall not infringe the rights of any third party.

3. When you buy from a seller on pal, you’re making a difference and contributing to the reuse of production equipment. By making a purchase via pal you agree that you have:

3.1 Read the item description;

3.2 Submitted appropriate payment for item(s) purchased; and

3.3 Provided accurate delivery information to the seller.

4. For the safety of our marketplace and to avoid scams and fraud, all transactions must take place through the Stripe checkout system, and only transactions that take place through this system will be accepted. The relevant terms can be found here https://stripe.com/en-gb/legal/ssa.
